Assistance regarding the constitutionality of an emoluments attachment order1 min read

Power Singh Inc. assisted a private company and its employee who were subject to an emoluments attachment order (EAO) to assess the constitutionality of the EAO. In this regard, Power Singh Inc. provided legal advice to the relevant parties on the requirements of the law following the Constitutional Court judgment in University of Stellenbosch Legal Aid Clinic v Minister of Justice and Correctional Services, and the subsequent amendment to the legislation. Further, Power Singh Inc. also provided a practical guidance note to the company in order to assist its management and other employees to understand the rights and obligations that arise in respect of an EAO, and to put in place appropriate systems and processes.
